Canada’s New Citizenship Bill: Canada has recently introduced a proposal for a ‘New Citizenship Bill’ (New Citizenship Bill C-3). This bill, introduced in Parliament on Thursday by Immigration Minister Lena Metlage Diab, has talked about abolishing the current rule of obtaining Canadian citizenship on the basis of inheritance. According to the rule introduced in the year 2009, any child born or adopted abroad of a Canadian citizen born outside Canada did not get Canadian citizenship. Now, an amendment to this rule has been proposed. What does the original law say? According to the current citizenship law of Canada, hereditary citizenship is limited only to the first generation born in Canada. Therefore, any Canadian citizen born outside Canada cannot give his citizenship to his child born (or adopted) abroad. A proposal named Bill C-3 has been introduced to correct the error in this law introduced in Parliament in the year 2009. New law will grant citizenship based on residence in Canada According to the new law, parents will have to show a โsubstantial connectionโ with Canada. The parents must have been present in Canada for at least 1,095 days (three years) before the childโs birth or adoption. This means that children born abroad will now be granted citizenship based on residence in Canada instead of being Canadian citizens. While the Trump administrationโs tightening of immigration policies in the US is having an adverse impact on Indians, this upcoming amendment to the immigration law in Canada is expected to benefit Indian immigrants (including all immigrant communities), as children born in India to Canadian citizens with substantial ties to Canada will now be eligible for Canadian citizenship under the C-3 bill. This benefit will also be available to children adopted abroad after the first generation. Government wants to implement this bill as quickly as possible The proposed bill is currently under legislative review. It will have to pass three readings and then receive royal assent to become law. If that happens, the Canadian government wants to implement this bill as quickly as possible.
